This AI & Assessment Disclaimer (the "Disclaimer") explains how the assessments, scores, opinions, and other outputs you see in Guac (the "Assessments") are generated, what they are, what they are not, and the important limits on how you should rely on them. Guac is operated by Banetry ("we," "us," or "our"). This Disclaimer is part of, and is incorporated by reference into, our Terms of Service, and it should be read together with our Privacy Policy, our Medical & Health Disclaimer, and our Subscription & Billing Terms. Capitalized terms not defined here have the meaning given to them in the Terms of Service.

By using Guac, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree, please do not use the Assessments.

1. What Guac Is (In Plain Terms)

Guac is an AI-powered "clean-eating buddy." You point Guac at a food — by taking a photo, scanning a barcode, scanning a restaurant or product menu, or typing a food name — and Guac, voiced through an avocado mascot, gives you an opinion about how clean versus processed that food appears to be, and whether it seems to fit the way of eating you chose (for example: eat cleaner, eat healthier, cut junk, or a named approach such as paleo, keto, mediterranean, plant-based, high-protein, or low-sugar).

Guac is entertainment, education, and motivation. It is gamified — with features like a "gains bar" and streaks — to make eating decisions more engaging. Guac is not a calorie counter, not a nutritionist, not a dietitian, not a doctor, and not a laboratory. It does not measure, weigh, or analyze the actual chemical or nutritional content of the food in front of you.

2. How Assessments Are Generated

Understanding how an Assessment is produced is the key to understanding its limits.

2.1 The inputs

When you submit a food, Guac works from one or more of the following, depending on how you scanned:

  • A photo you take of a food, dish, package, or label;
  • A barcode you scan from a packaged product;
  • A menu (restaurant or product menu) you scan;
  • A food name or description you type; and/or
  • Public food databases and reference data, including Open Food Facts and the USDA FoodData Central dataset, used to look up ingredient lists, product names, and similar information.

2.2 The AI step

Guac sends the relevant input to a third-party generative artificial-intelligence service (Google's Gemini) to help identify the food and read or interpret any available ingredient list, product name, or label text. The AI's job is essentially to recognize and name what the food appears to be and to surface the ingredients or descriptors associated with it.

As described in our Privacy Policy, the food photos, barcodes, and typed inputs you submit are sent to Google for analysis, are not stored on our servers, and are not used to train AI models. Generic food and barcode lookups may be cached keyed only to the query (for example, a barcode number) and not to you or your account.

2.3 The scoring step

The identified food and its ingredients are then evaluated against our own rules and reference tables to produce the opinion, score, and commentary you see — including how the food maps to your chosen way of eating. This scoring layer is designed to be consistent, so that the same identified ingredients tend to produce the same result. Where a food or ingredient is unknown or cannot be confidently identified, Guac generally treats it conservatively rather than guessing.

2.4 The bottom line on method

Every Assessment is therefore the product of (a) an automated identification step that can misidentify or misread food, and (b) a rules-based opinion step applied to whatever was identified — often from an ingredient list or food name alone, and not from the actual food, its preparation, its portion, or its true composition. An Assessment is a computed opinion about the available information, not a measurement of the food itself.

3. Assessments Are Opinions and Educational Estimates — Not Facts

Every Assessment is a subjective opinion and an educational estimate. It is not a statement of fact.

  • Guac's outputs — including any "clean vs. processed" characterization, fit-to-diet verdict, score, gains-bar movement, the avocado mascot's commentary, and any approval, hesitation, or disapproval it expresses — reflect generalized, opinion-based judgments generated by software. Reasonable nutrition professionals, and reasonable people, may disagree with any given Assessment.
  • Assessments are offered for general informational, educational, and motivational purposes only.
  • An Assessment is not a guarantee, certification, endorsement, warning, ranking, rating of quality or safety, or any representation that a food is "good," "bad," "safe," "unsafe," "healthy," or "unhealthy" for you or for anyone.
  • Mascot personality, tone, humor, and gamified feedback (streaks, the gains bar, encouraging or skeptical reactions) are creative and motivational devices, not analytical conclusions.

You should treat any Assessment the way you would treat a friend's casual opinion about a food — interesting and potentially helpful, but not authoritative.

4. Assessments May Be Incomplete, Outdated, or Wrong

AI systems and food data have real, well-known limitations. Assessments can be — and sometimes will be — inaccurate, incomplete, outdated, or simply wrong. Among other things:

  • Misidentification. The AI may misidentify the food, confuse one item for another, miss items in a photo, or misread a label, menu, or barcode.
  • Wrong or missing ingredients. Ingredient lists from public databases or labels may be incomplete, outdated, mislabeled, regionally different, or incorrect. Manufacturers change recipes, suppliers, and formulations without notice. Open Food Facts is community-contributed and may contain errors; USDA FoodData Central reflects reference data that may not match a specific product or restaurant item.
  • Preparation and portion blindness. Guac generally cannot account for how a food was actually prepared, cooked, seasoned, portioned, substituted, or combined with other foods, nor for added oils, sauces, sugars, or hidden ingredients not reflected in the data it received.
  • Allergens and contamination. Guac is not an allergen-detection tool. It cannot reliably detect allergens, cross-contamination, trace ingredients, or "may contain" risks. Never rely on Guac to determine whether a food is safe for an allergy, intolerance, medical condition, religious requirement, or dietary restriction. Always read the actual product label and check with the manufacturer or establishment.
  • AI variability and "hallucination." Generative AI can produce confident-sounding output that is nonetheless incorrect or fabricated. A polished, specific Assessment is not evidence that it is correct.
  • Currency. Assessments reflect data and models available at the time of the scan and may become outdated.

5. No Claims, Accusations, or Disparagement About Any Brand, Product, or Company

This Section is important. Guac does not make any factual claim, accusation, or disparaging statement about any brand, product, restaurant, manufacturer, retailer, or company.

  • Identification only. Where a brand name, product name, restaurant name, logo, trademark, or similar identifier appears in or near an Assessment, it is used solely to identify the food item you scanned or searched — the same way you might name a product in conversation. Its appearance is not a statement about that brand or company and not any form of affiliation, sponsorship, endorsement, partnership, or approval, in either direction.
  • Opinion, not fact. Any characterization of a food (for example, that it appears "processed," "ultra-processed," "clean," or "off-plan") is a subjective opinion and educational estimate about the available ingredient or data information — not an assertion of objective fact about the product, its quality, its safety, its legality, or the company that makes or sells it.
  • No disparagement intended or made. Nothing in any Assessment is intended as, or should be read as, an accusation of wrongdoing, a claim of harm, a claim of mislabeling or adulteration, a safety warning, a comparative quality ranking, or a statement that any product is inferior, dangerous, deceptive, or non-compliant. We make no such claims.
  • Based only on available data. Assessments are generated only from the limited ingredient lists, names, labels, images, and public data available to Guac, which (as Section 4 explains) may be wrong or incomplete. An Assessment is therefore never a reliable basis for forming a factual belief about a brand or company, and you should not treat it as one.
  • Trademarks. All product names, brand names, logos, and trademarks are the property of their respective owners. Their use in Guac is nominative — for identification and commentary only — and does not imply any relationship with their owners.

If you are a brand owner, manufacturer, restaurant, or other rights holder and you believe an item is misidentified or an ingredient list is inaccurate, please contact us at help@banetry.com so we can review and, where appropriate, correct or remove the relevant data. See Section 7.

6. Not Professional, Medical, Nutritional, or Dietary Advice

Guac is not a medical device and has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority. Guac does not diagnose, treat, cure, prevent, or mitigate any disease or health condition.

Assessments are not professional, medical, nutritional, dietary, psychological, or fitness advice, and they are not a substitute for consultation with a qualified, licensed professional who knows your individual circumstances. Do not use Guac to make medical decisions, to manage a health condition, to treat or prevent any disease, or to determine whether a food is safe given an allergy, intolerance, pregnancy, medication, or medical condition.

Always seek the advice of your physician, registered dietitian, or other qualified health provider with any questions about your diet, nutrition, or a medical condition, and never disregard or delay professional advice because of something you read or saw in Guac. This Section is summarized here for convenience; the full terms, including the assumption-of-risk and responsibility provisions, are set out in our Medical & Health Disclaimer and Terms of Service.

7. AI Limitations and How to Report a Problem or Request a Correction

We want Assessments to be as useful and accurate as possible, and we recognize that AI gets things wrong. Because Assessments are generated automatically, we do not pre-review individual Assessments, and we cannot guarantee that any given Assessment is correct.

If you believe an Assessment is inaccurate, an item is misidentified, an ingredient list is wrong or outdated, or a brand or product is mischaracterized:

  • You can rescan or re-enter the food. A clearer photo, a direct barcode scan, or a typed product name often produces a more accurate result.
  • Always defer to the actual label. Where Guac and the physical product label disagree, the product label controls — not Guac.
  • You can report it to us. Email help@banetry.com (or use the in-app feedback option, where available) with the food, the issue, and any supporting detail. We review reports and may correct underlying reference data, adjust our rules, or remove problematic data, but we are not obligated to take any particular action, and corrections — when made — apply going forward and may take time to appear.

Some underlying data comes from third parties (Google/Gemini, Open Food Facts, USDA FoodData Central). We do not control those sources and cannot guarantee their accuracy, completeness, availability, or timeliness, and we are not responsible for errors originating from them.

8. AI Transparency

In the spirit of transparency about automated systems, we want to be clear and direct:

  • Assessments are produced with the help of artificial intelligence. They are generated by software — including a third-party generative AI model — and not authored by a human reviewing your specific food.
  • AI can be wrong. As described above, AI outputs may be inaccurate, incomplete, biased, or fabricated, and confident phrasing is not a sign of correctness.
  • The mascot is a character. The avocado mascot, its personality, and its reactions are a creative presentation layer. The mascot is not a real person, not an expert, and not giving you a professional opinion; "his" verdicts are gamified, opinion-based feedback.
  • We don't hide the AI, and you shouldn't over-trust it. We disclose AI use so you can calibrate your reliance accordingly — use Assessments as a fun, motivational nudge, and verify anything that matters.

9. Assumption of Risk and Your Responsibility

You are solely responsible for your own food, dietary, health, and lifestyle decisions. You understand and agree that:

  • Any reliance you place on an Assessment is at your own risk;
  • Guac is provided for general informational, educational, and motivational purposes and is offered "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law;
  • You will use your own judgment, read actual product labels, and consult qualified professionals where appropriate before acting on anything you see in Guac; and
  • To the maximum extent permitted by applicable law, Banetry is not liable for any decision you make, or any harm, loss, or damage you suffer, in connection with an Assessment or your use of Guac.

Additional terms — including warranty disclaimers, limitations of liability, indemnification, the governing law of the State of Florida, and dispute resolution and arbitration in Miami-Dade County, Florida — are set out in our Terms of Service and control in the event of any conflict with this Disclaimer.

10. Changes to This Disclaimer

We may update this Disclaimer from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice through Guac or our website at banetry.com. Your continued use of Guac after an update means you accept the revised Disclaimer.
