This Health & Medical Disclaimer (the "Disclaimer") applies to the "Guac" mobile application, the avocado mascot and related features (collectively, the "App"), and the website at banetry.com (the "Site," and together with the App, the "Service"), each operated by Banetry ("we," "us," or "our"). This Disclaimer is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. Please also review our Privacy Policy and our AI & Assessment Disclaimer for related terms.
By downloading, accessing, or using Guac, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree, do not use Guac.

- Guac is not medical advice, not nutritional advice, and not a substitute for a doctor, dietitian, or other qualified professional.

- Guac's food assessments are opinions generated by artificial intelligence from limited ingredient and product data, and they may be incomplete, outdated, or wrong.

2. Educational and Informational Purpose Only
Guac is a gamified clean-eating "buddy." Users submit food information by photo, barcode, or restaurant menu, or by typing a food, and the Guac mascot returns an opinion about how "clean" versus "processed" a food appears to be and whether it appears to fit a user's self-selected way of eating (for example, keto, paleo, vegan, mediterranean, high-protein, low-sugar, or "eat cleaner"). Features such as the gains bar, streaks, and verdicts are designed for engagement and general education.
All content provided through Guac — including assessments, scores, verdicts, opinions, ratings, the gains bar, suggestions, commentary, and any text the mascot generates — is provided for general informational, educational, and entertainment purposes only. It is not intended to be, and must not be treated as, professional advice of any kind.
Guac is not a calorie counter and does not purport to measure calories, macronutrients, micronutrients, portion sizes, or your individual nutritional needs.
3. Not Medical or Nutritional Advice
Guac does not provide medical, nutritional, dietetic advice, diagnostic services, or treatment of any kind.
Nothing in or generated by Guac is intended to:
- diagnose, treat, cure, mitigate, or prevent any disease, condition, illness, or health problem;
- constitute or replace the advice of a physician, registered dietitian, nutritionist, pharmacist, therapist, or other qualified health professional;
- create a doctor-patient, dietitian-client, or any other professional relationship between you and Banetry or anyone associated with Guac; or
- serve as a basis for any medical, dietary, or health decision without independent professional confirmation.
Guac has no knowledge of your personal medical history, allergies, intolerances, medications, lab results, pregnancy or nursing status, age-specific needs, or any individual health circumstances. Guac's general opinions are not tailored to you and cannot account for your individual situation.
4. Not a Medical Device; Not FDA-Evaluated
Guac is a general consumer wellness and lifestyle application. Guac is not a medical device. It is not intended to be used in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease, and it is not intended to affect the structure or function of the body in any way that would make it a medical device under the U.S. Federal Food, Drug, and Cosmetic Act or any comparable law.
Statements about Guac and any content within Guac have not been evaluated by the U.S. Food and Drug Administration (FDA) or by any other governmental or regulatory authority. Guac is not intended to diagnose, treat, cure, or prevent any disease.
5. Assessments Are AI Opinions From Limited Data and May Be Wrong
Guac's assessments are produced by automated and artificial-intelligence systems (including third-party AI services) based only on the limited ingredient and product data available for a given food, barcode, or menu item. These assessments are subjective opinions, not statements of fact.
You acknowledge and agree that Guac's output:
- may be incomplete, inaccurate, outdated, or simply wrong;
- is based on data that may be missing, mislabeled, ambiguous, or incorrectly recognized (for example, a misread photo, an unrecognized barcode, an outdated public food record, or a vague menu description);
- reflects general heuristics and the conventions of a chosen "way of eating," not a measurement of your personal health impact;
- can vary, and may produce different results for similar inputs; and
- should be treated as a starting point for your own judgment, never as a definitive or authoritative determination.

6. Allergen and Food-Safety Warning — Read the Real Label
This is critical.
Do not rely on Guac to determine whether a food is safe for you to eat. Guac is not an allergen-detection tool, an ingredient-verification tool, or a food-safety tool, and it must never be used as one.
If you have a food allergy, intolerance, sensitivity, celiac disease, a medical condition affected by diet, or any other reason that a particular ingredient could harm you, you must:
- read the actual physical product label, packaging, and ingredient statement for the specific product you intend to consume;
- confirm ingredients, "may contain" / cross-contamination warnings, and preparation details directly with the manufacturer or restaurant; and
- not treat Guac's opinion as confirmation that a food is free of any allergen, additive, or ingredient.
Guac may fail to identify an ingredient, may misidentify a product, may rely on outdated or incorrect data, and may not reflect recent recipe changes, regional differences, or cross-contamination. An allergic reaction or other adverse event can be severe or fatal. The real label and the manufacturer or restaurant are always the authoritative source — Guac is not.
7. Do-Not List
You agree that you will not use Guac to do any of the following, and you understand that Guac is not capable of doing any of the following:
- Diagnose, treat, monitor, or manage any disease, condition, symptom, or health concern.
- Start, stop, change, or skip any medication, supplement, treatment, or therapy.
- Replace or override the advice, diagnosis, treatment plan, or instructions of a qualified health professional.
- Make allergen, intolerance, or food-safety decisions without reading the real label and confirming with the manufacturer or restaurant (see Section 6).
- Delay or avoid seeking professional medical care because of something you read, saw, or were told in Guac.
- Determine medical-grade dietary requirements (for example, a renal, diabetic, low-FODMAP, phenylketonuria, or other clinically prescribed diet) — these require a qualified professional.
8. Always Consult a Qualified Professional
Always seek the advice of your physician, registered dietitian, or other qualified health professional with any questions you may have about your health, diet, nutrition, a medical condition, a new eating plan, or before making any change to your diet, exercise, medication, supplements, or lifestyle.
This is especially important if you:
- are pregnant, nursing, or trying to conceive;
- are a minor, an older adult, or caring for someone who is;
- have a chronic illness or any diagnosed medical condition;
- have a history of disordered eating or an eating disorder;
- take prescription medication or supplements; or
- have any food allergy, intolerance, or sensitivity.
Guac is intended as a lighthearted, motivational companion — not as a clinician. Its encouragement, verdicts, streaks, and gamified features are designed to be supportive and engaging, and should never be used in a way that promotes unhealthy, restrictive, or obsessive behavior.
9. Emergency Instruction
Guac is not for emergencies and cannot help in an emergency.
If you think you may have a medical emergency, are experiencing a severe allergic reaction (such as difficulty breathing, swelling, hives, or anaphylaxis), or are in crisis, call your local emergency number immediately — 911 in the United States — or go to the nearest emergency room. Do not wait. Do not use Guac to assess or manage an emergency.

10. Assumption of Risk; Your Responsibility
You understand and agree that:
- You use Guac voluntarily and at your own risk.
- You are solely responsible for your own dietary, nutritional, health, and lifestyle decisions, and for any actions you take or do not take based on Guac.
- You should independently verify any information from Guac and confirm it with the actual product label and a qualified professional before relying on it.
- To the fullest extent permitted by law, you assume all risk arising from your use of Guac and any reliance on its content, and you release Banetry from liability for such use and reliance, subject to and as further described in the limitation-of-liability, disclaimer-of-warranties, and indemnification provisions of our Terms of Service.
11. Relationship to Other Documents
This Disclaimer supplements, and is incorporated into, our Terms of Service and should be read together with our AI & Assessment Disclaimer (regarding the nature and limits of AI-generated opinions and the no-claims-about-brands shield) and our Privacy Policy (regarding the data we collect and how we use it). If there is a conflict between this Disclaimer and the Terms of Service on a health-related matter, this Disclaimer controls for that matter; in all other respects the Terms of Service control.
12. Changes to This Disclaimer
We may update this Disclaimer from time to time. When we do, we will revise the "Effective Date" above and, where appropriate, provide notice through the Service. Your continued use of Guac after an update means you accept the revised Disclaimer.
