Guac — Terms of Use
Effective date: July 12, 2026 (supersedes the June 20, 2026 version)
These Terms of Use ("Terms") are a binding agreement between you and Banetry ("we", "us", "our") governing your use of the Guac mobile application, the banetry.com website, and all related features, content, and services (together, the "Service" or the "App"). By tapping to accept these Terms, by creating an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum digital-consent age where you live) to use Guac, and if you are under 18 you must have a parent or guardian's permission. By using the Service you represent that you meet these requirements.
2. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on Apple devices you own or control, for your personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, sublicense, or use the Service except as these Terms allow.
3. Accounts
You can sign in with Sign in with Apple or Google Sign-In. You are responsible for your account and for keeping access to it secure, and you agree that the information associated with your account is accurate.
- One account per person. You may not share, sell, or transfer an account.
- Deleting your account. You can delete your account at any time in the App (Profile → Settings). Deletion removes your account data as described in the Privacy Policy. Deleting the App itself does not delete your account or cancel a subscription.
4. What Guac is — and what it is NOT
Guac is an educational and informational wellness tool. It uses artificial intelligence to give you an opinion and estimate about how "clean" vs. "processed" a food appears and whether it fits the way of eating you select, so you can make your own choices.
Guac is NOT: a medical device; a source of medical, nutritional, or professional advice; a diagnostic or treatment tool; a food-safety, allergen, or regulatory authority; or a guarantee of any health, fitness, weight, or other outcome.
5. How assessments work — accuracy, ingredients only, and no claims about brands
This section is important. By using the Service you acknowledge and agree to all of it.
- Ingredient- and data-based opinions only. Guac's assessments are generated automatically by AI based solely on the information available to it — for example, the ingredient list, the food or product name you provide, a photo you submit, or data from public food databases. Guac evaluates the general processing level and dietary fit of ingredients. It does not inspect, test, or verify any product, and it does not have complete or authoritative information about any product.
- Opinions, not statements of fact. All assessments, scores, labels (such as "clean" or "processed"), and commentary are subjective opinions and educational estimates, not statements of fact, and they may be incomplete, outdated, or wrong (for example, because ingredient data is missing, mislabeled, or has changed).
- No claims, accusations, or disparagement of any brand, product, restaurant, manufacturer, or company. Guac does not make, and does not intend to make, any factual claim, accusation, or representation about any specific brand, product, restaurant, manufacturer, or company — including about its quality, safety, healthfulness, legality, or business practices. Nothing in the Service is intended as, or should be construed as, a statement of fact about, or disparagement of, any third party or their products. Any name shown is used only to identify the item you asked us to assess.
- Not a substitute for the label. Always read the actual product packaging, ingredient list, and allergen information before purchasing or consuming any food, especially if you have allergies, intolerances, or medical conditions. Do not rely on Guac for allergen or food-safety decisions.
- Corrections. If you believe an assessment is inaccurate, please contact us at help@banetry.com so we can review it.
6. Health and medical disclaimer
Guac does not provide medical advice. The Service's information is general and educational only and is not a substitute for professional medical, nutritional, or healthcare advice, diagnosis, or treatment. Always seek the advice of a qualified physician or registered dietitian before making changes to your diet, exercise, supplement, or health routine, and never disregard or delay professional advice because of something in the Service. Guac has not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulator. In an emergency, call your local emergency number. You use any information from the Service at your own risk.
7. Your responsibilities and assumption of risk
You are solely responsible for your own dietary, health, purchasing, financial, and lifestyle decisions. Guac is a tool that gives you information; it does not make decisions for you. You assume all risk arising from your use of the Service and from any action you take, or choose not to take, based on its outputs. You agree to use the Service lawfully and not to misuse, overload, scrape, or attempt to disrupt or reverse-engineer the Service or our systems, and not to submit unlawful, infringing, or harmful content.
Fair use of AI features. Guac's scans, assessments, and other AI-powered features are powered by artificial-intelligence services that cost real resources to run, so access to them is subject to fair-usage limits — for example, a reasonable cap on the number of scans or AI requests within a given period, which may differ between tiers. These limits exist to keep the service fast, affordable, and available to everyone, and to prevent abuse. We may set, change, or remove these limits over time, and we may throttle, temporarily pause, or restrict AI access where usage is excessive, automated, or appears intended to disrupt, overload, or gain unfair advantage from the service. A subscription raises but does not remove these fair-usage limits.
8. Community features and code of conduct
Guac includes social features such as a community feedback board, friends, groups, and leaderboards. When you use them:
- Be decent. You may not post content that is unlawful, hateful, harassing, threatening, obscene, sexually explicit, discriminatory, violent, misleading, spammy, or that infringes anyone's rights. Automated filters and human moderation screen community content, and we may remove any content, restrict features, or suspend or ban accounts at our discretion, with or without notice.
- No impersonation. You may not choose a name or username that impersonates another person, brand, or any Guac/Banetry role (for example "owner", "admin", "staff", "moderator", "support", "official" or lookalike variations). Usernames are unique, may be permanent once claimed, and we may reclaim or remove any username that violates these Terms. The @owner account is the official founder account of Guac; replies labeled as coming from the Guac team appear only from that account.
- Reporting. You can report content or users in the App. We review reports but do not guarantee any particular action.
- No private messaging. Community features are text-only, public-to-the-community surfaces; Guac does not offer direct messaging.
- Leaderboards and fair play. Manipulating scores, streaks, ranks, or referral systems (including through automation, multiple accounts, falsified data, or exploits) is prohibited and may result in score resets, removal from leaderboards, forfeiture of rewards, or account termination.
9. Virtual items, badges, and rewards
Guac may offer streaks, badges, cosmetic items for the Guac character, crowns, leaderboard placements, and similar features ("Virtual Items"). Virtual Items are a feature of the Service: they have no monetary value, cannot be sold, transferred, exchanged, or redeemed for money or anything of value, and are not your property. We may add, change, rebalance, or remove Virtual Items and the requirements to earn them at any time. Rewards obtained through bugs, exploits, or violations of these Terms may be revoked.
10. Promotional, referral, and creator codes
We may offer promotional, referral, or creator codes that unlock discounted pricing or other benefits. Codes are limited in number and duration, non-transferable, have no cash value, may be modified or revoked at any time, and may not be resold or publicly redistributed without our permission. Discounted subscriptions still purchase and renew through the App Store under Section 11. Abuse of codes (including automation or multiple accounts) may result in revocation of benefits and account termination.
11. Subscriptions, billing, auto-renewal, and cancellation
Guac offers auto-renewable subscriptions (for example, weekly and yearly plans) that unlock the App's features. Prices are shown in the App at the time of purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Free trials / introductory offers (for example, a 3-day free trial), where offered, automatically convert to a paid subscription at the displayed price unless cancelled at least 24 hours before the trial ends; any unused portion of a free period is forfeited if you purchase a subscription.
- Auto-renewal: subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- How to cancel: manage or cancel anytime in Settings → your Apple ID → Subscriptions on your device, or from the subscription screen inside the App. Deleting the App does not cancel a subscription.
- Refunds are handled by Apple under the App Store's policies; we generally cannot grant refunds directly.
- We may change features or prices prospectively; changes do not affect a period you've already paid for.
12. User content and feedback
You retain ownership of content you submit (such as photos, notes, community posts, and usernames). You grant us a worldwide, royalty-free license to host, process, display, and moderate that content solely to operate, secure, and improve the Service as described in the Privacy Policy. You are responsible for the content you submit and confirm you have the right to submit it. If you send us ideas, suggestions, or feedback (including through the community board), you agree we may use them freely, without restriction or compensation.
13. Intellectual property
The Service, including its software, design, the Guac character and artwork, text, and branding, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in our intellectual property except the limited license in Section 2. If you believe content in the Service infringes your copyright, contact help@banetry.com with the details required for a notice under applicable law (for U.S. users, the DMCA), and we will respond appropriately, including removing infringing material and terminating repeat infringers.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any assessment, score, or output will be accurate, reliable, or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANETRY AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON ITS OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing here limits liability that cannot be limited by law.
16. Indemnification
You agree to indemnify and hold harmless Banetry and its owners, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your decisions, or your violation of these Terms or applicable law.
17. Changes to the Service or Terms
We may modify, suspend, or discontinue the Service or any feature at any time. We may update these Terms; the updated version takes effect when posted, and material changes will be highlighted in-app or on the website. Your continued use after changes means you accept the updated Terms.
18. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Sections that by their nature should survive (including Sections 4–10 and 12–21) survive termination.
19. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules.
Please read this arbitration clause carefully — it affects your legal rights. To the extent permitted by law, you and we agree that any dispute relating to the Service or these Terms will be resolved by binding individual arbitration (not in court and not before a jury), administered under the rules of a recognized arbitration provider, seated in Miami-Dade County, Florida. You and we waive any right to participate in a class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing help@banetry.com with the subject "Arbitration Opt-Out." Nothing here prevents either party from seeking relief in small-claims court, and consumers in some regions (e.g., the EU/UK) retain mandatory local rights and courts that this section does not override.
20. Apple App Store terms
These Terms are between you and Banetry, not Apple, and Apple is not responsible for the App or its content. You agree that:
- Apple has no obligation to provide maintenance or support for the App;
- in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation;
- Apple is not responsible for any claims relating to the App (including product-liability, legal/regulatory, or consumer-protection claims);
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
- you represent that you are not located in a country subject to a U.S. embargo or on a U.S. prohibited-parties list.
21. General
If any provision of these Terms is found unenforceable, the rest remain in full effect. These Terms (with the Privacy Policy and any in-app disclosures) are the entire agreement between you and us about the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms limits any non-waivable consumer rights you have under local law.
