These Terms of Use ("Terms") govern your access to and use of banetry.com and its subpages (the "Site"), operated by Banetry LLC ("Banetry," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

Use of any Banetry mobile application is governed by that app's own Terms of Service, not by these Terms.

1. Permitted use

The Site is an informational and marketing website. You may view, download, and print pages for your own non-commercial reference. You agree not to:

  • interfere with or disrupt the Site, its servers, or its security;
  • attempt unauthorized access to any system or data;
  • scrape, crawl, or harvest content at a scale that burdens the Site, except by well-behaved search-engine crawlers respecting our robots.txt;
  • use the Site to distribute malware, spam, or unlawful material;
  • frame, mirror, or resell the Site or its content.

2. Intellectual property

The Site, its text, design, layout, graphics, logos, app icons, and the marks Banetry and Guac are owned by Banetry LLC or its licensors and are protected by copyright, trademark, and other laws. No license is granted except the limited viewing right in Section 1. Third-party marks (such as Apple and App Store) belong to their owners.

3. No professional advice

Content on the Site is provided for general information only. It is not medical, nutritional, legal, or financial advice, and it does not create any professional relationship. The Site links to third-party destinations, including the Apple App Store. We do not control and are not responsible for third-party sites, their content, or their practices. Your use of them is governed by their terms and policies.

5. Availability and changes

We may modify, suspend, or discontinue any part of the Site at any time, and we do not guarantee uninterrupted or error-free availability. We may update these Terms; continued use after an update means you accept the revised Terms.

6. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

7. Limitation of liability

To the maximum extent permitted by law, Banetry LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site. Our total aggregate liability relating to the Site will not exceed USD $100.

8. Indemnity

You agree to indemnify and hold Banetry LLC harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or breach of these Terms.

9. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, unless mandatory local law grants you another forum.
